Opinions & Advisory Letters

At the request of elected officials, the New Mexico Department of Justice prepares opinions and advisory letters. Policymakers often rely on opinions issued our office to help them make informed decisions as they evaluate proposed statutory changes and new legislation.

Consumer Guides

The New Mexico Department of Justice produces several consumer guides to protect and assist consumers in making informed decisions.

Compliance Guides

The New Mexico Department of Justice has developed compliance guides for the Inspection of Public Records Act, Open Meetings Act, and Governmental Conduct Act to provide public bodies with guidance on ethical and legal conduct.

Officer Involved Shooting Reports

Upon request, the New Mexico Department of Justice performs prosecutorial reviews of officer involved shootings. These reviews are made available to the public upon completion.

Appellate Law Updates

On a roughly semi-annual basis, the Criminal Appeals Division provides presentations detailing updates on appellate law along with basic information regarding the appellate process.

Annual Reports

The New Mexico Department of Justice’s Annual Report is a comprehensive, in-depth document that provides a detailed review of the year’s activities.

Charitable Organization Registrations

Charitable organizations which exist, operate or solicit contributions in New Mexico are required, by law, to register with the New Mexico Department of Justice and to submit financial reports on a yearly basis.

Legislative Analyses

At the request of the Legislative Finance Committee (LFC), attorneys with the New Mexico Department of Justice provide analyses of proposed legislation. This archive contains all analyses submitted by our office from 2016 to the present.

Electronic Communications Privacy Act (ECPA) Reports​

Under the Electronic Communications Privacy Act (“ECPA”), NMSA 1978, Sections 10-16F-1 to -6, all law enforcement agencies in New Mexico must report the execution of a warrant to obtain electronic communication information to the New Mexico Department of Justice.
