ALBUQUERQUE, NM—Today, Attorney General Hector Balderas announced that Victor
Gonzales was arrested late last night on charges of Kidnapping, Criminal Sexual
Penetration, and Aggravated Battery stemming from a 2010 sexual assault. In 2010, the
female survivor immediately reported to law enforcement that she was abducted and
sexually assaulted by an unknown male. Although a Sexual Assault Examination Kit was
completed after the incident, it remained untested for 8 years. After testing, the male DNA
was entered into the Combined DNA Index System (CODIS) and matched to a known
sex offender, Victor Gonzales.
“We must protect our community from violent sexual predators,” said Attorney General
Balderas. “We will continue to fight for survivors of sexual violence to ensure that
offenders are held accountable.”
Gonzales has been prosecuted previously by the Second Judicial District Attorney’s office
for several sexual assaults between 2010 and 2012. The Office of the Attorney General
has filed a preventative detention motion in the current case, asserting that Gonzales
is dangerous to the community and should be held in custody pending trial. A copy of the
motion is attached.
