IMPORTANT INFORMATION FOR LICENSED DISTRIBUTORS
OF TOBACCO PRODUCTS SELLING PRODUCTS IN NEW MEXICO.

The Distributor Monthly Reports filed with Taxation and Revenue must now be submitted to the office of the Attorney General at the same time it is filed with Taxation and Revenue.

All distributors of tobacco products selling or delivering tobacco products that are subject to the requirements of the Master Settlement Agreement between the tobacco manufacturers and the settling states into the State of New Mexico must meet certain criteria to sell or deliver their products.

You should not sell or ship into New Mexico any brands that are not on the Attorney General’s approved list and properly stamped. They may be considered contraband.

  1. You must be licensed in New Mexico with the Taxation and Revenue Department of the State of New Mexico.

  2. You may only bring into the State cigarettes and tobacco products that have a tax stamp affixed to the package. These stamps are available at the New Mexico Taxation and Revenue Department. Whether your tobacco products are taxed or non-taxed, they must have a stamp affixed. The Taxation and Revenue Department has both types of stamps available for your use.

  3. You may only sell brands and brand families that are listed on the New Mexico Attorney General’s directory listed on this web site. The web page includes both Participating Manufacturers and Non-Participating Manufacturers that are compliant in New Mexico pursuant to New Mexico Statute and is a complete list of their current brand families that are approved for sale in New Mexico. In the case of a brand or manufacturer that is no longer compliant, the date of removal is shown in red. Those brands are NOT compliant.

  4. Any brands not listed on the Attorney General’s web page are considered contrabrand by the State of New Mexico, and may be subject to seizure.
