What is a door-to-door sale?
A door-to-door sale is an offer or sale of a product or service that
costs more than $25.00 and is made at any place besides the seller’s place
of business.
What is the buyer’s right of cancellation regarding door-to-door sales?
The buyer can cancel the contract or get refunded the complete amount
of the transaction for any reason as long as cancellation was within 72 hours after
purchase, excluding Sundays and New Mexico official holidays.
What requirements must a salesperson meet to comply with the Door-to-door
Sales Act?
In order to comply with the Door-to-door Sales Act,
a salesperson must:

Provide the buyer
a fully completed receipt or copy of the contract(s), which must be in the same
language as principally used in the oral sales presentation and shows the date of
the transaction as well as the last date the contract can be cancelled. It
must also contain the name and address of the seller and, in immediate proximity
to the space reserved for the buyers signature, the following statement must be
in ten-point boldface font:
“You, the buyer, may cancel this transaction at any time prior to midnight
of the third business day after the date of this transaction. See the attached
Notice of Cancellation form for an explanation of this right.”
- Provide the buyer
a “Notice of Cancellation” form attached to the contract, completed
in duplicate, and easily detachable, which contains the same language as required
by the Door-to-door Sales Act in ten-point boldface font.
- Orally inform the buyer of his/her right to cancel at
the time the contract is signed.
All the conditions mentioned above must be met in order for a door-to-door
sale to comply with New Mexico’s Door-to-door Sales Act.
How many days does a door-to-door salesperson have to refund all your money
if you decided to cancel within three days?
Ten (10) days.
Do you have to provide a reason to a door-to-door salesperson in order to
cancel a sales transaction?
No.
How many days does a door-to-door salesperson have to pick up the goods
left with you or pay you to mail the items back?
Twenty days, after that the goods left with you become yours.
