(ALBUQUERQUE)---Attorney General Gary King's office has secured an indictment against Antoinette Lopez, of Albuquerque, on one count of Medicaid Fraud, one count of Falsification of Documents, and one count of Forgery over $2500.

The AG's Medicaid Fraud & Elder Abuse Division reports that the Medicaid Fraud and Falsification of Documents charges are fourth degree felonies, while the Forgery charge is a third degree felony.

"The message should be clear that the Attorney General's Office is very motivated and engaged in prosecuting these types of offenses against the elderly and the system that provides for their care," says AG King.

The indictment, by a Bernalillo County grand jury, alleges the Defendant, between March 2009, and March 2010, provided Medicaid-funded respite care services which were inadequate, or submitted false claims for provision of respite care services. Count II alleges Falsification of Documents during the same time period. Count III alleges forged timesheets for respite care services were submitted during this period as well.

The Defendant could face up to eighteen (18) months imprisonment for the Medicaid fraud count and the Falsification of Documents count, and up to three years imprisonment for the Forgery count. The case has been assigned to Second Judicial District Judge Ross Sanchez. An arraignment date has not yet been scheduled.
