(SANTA FE)---Attorney General Gary King's office has filed a response to convicted child sex offender Wayne Bent's petition to the NM Supreme Court for an appeal bond, asking the Court to deny the request.
In its response, the Attorney General's Office states:
The State of New Mexico respectfully asks this Court to deny any relief.
The granting or denial of an appeal bond is governed by statute and rule. Both the state district court and the New Mexico Court of Appeals properly interpreted and applied the statute and rule in determining whether Petitioner Bent was entitled to an appeal bond. The evidence was sufficient to deny an appeal bond. No factual ground or legal argument has been presented to revisit the rulings made by the two lower courts...The State of New Mexico respectfully requests this Court deny the Petition.
The Attorney General's response was filed Thursday in Santa Fe.
